These Terms of Service (“Terms”) govern your use of the FloatText mobile application and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must comply with applicable laws and the rules of the platform where you downloaded the app (e.g., Apple App Store). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
FloatText provides teleprompter features such as floating text overlays, script management, and recording/export tools. Some features are available only with a paid subscription. Features may vary by device and iOS version. We may update, change, suspend, or discontinue any part of the Service at any time.
3. Your Content
3.1 Content you provide
You may input scripts, text, or other materials (“User Content”). You retain ownership of your User Content. You are responsible for ensuring you have all rights needed to use your User Content in the Service.
3.2 Storage
The Service may store User Content and recordings locally on your device and/or in system storage locations (e.g., Photos), depending on your settings and permissions. You are responsible for backing up your device and content.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, or fraudulent purposes.
- Upload or create content that infringes others’ intellectual property or privacy rights.
- Reverse engineer, decompile, modify, or attempt to extract the source code of the Service, except where permitted by law.
- Interfere with or disrupt the Service, or attempt to bypass security or access controls.
5. Ads, Analytics, and Tracking
The free version of the Service may display advertisements. We also use analytics and diagnostics tools to understand app usage and improve stability and performance. Depending on your settings and permissions, these tools may use device identifiers.
- Ads: We use Google AdMob to serve ads in the free version.
- Analytics/Diagnostics: We use Firebase and TalkingData for analytics, diagnostics, and performance monitoring.
- ATT / Tracking: On iOS, we may request permission under App Tracking Transparency (ATT) to access the advertising identifier (IDFA) and enable personalized ads or measurement. If you decline, we will not access IDFA for tracking.
6. Subscriptions and Payments
Some features require a paid subscription. Payments are processed by Apple through your Apple ID and are subject to Apple’s terms.
- Billing: Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal: Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Manage / Cancel: You can manage and cancel subscriptions in your device’s Account Settings after purchase.
- No partial refunds: If you cancel, you retain access until the end of the current billing period. The current period is not refunded except as required by law or by Apple’s policies.
- Free trials: If a free trial is offered, unused portions are forfeited when purchasing a subscription (where applicable).
7. Intellectual Property
The Service (software, design, trademarks, logos) is owned by FloatText or its licensors and is protected by intellectual property laws. You receive a personal, non-exclusive, non-transferable, revocable license to use the Service for your own purposes, subject to these Terms.
8. Third-Party Services
The Service may use or integrate third-party services (e.g., Google AdMob, Firebase, TalkingData, Apple services). Your use of those services is governed by their own terms and policies. We are not responsible for third-party services.
9. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, FloatText disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, FloatText will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Service.
11. Termination
We may suspend or terminate your access if you violate these Terms or if required by law. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Effective Date” above. Continued use after changes become effective means you accept the updated Terms.
